So the Enforced Standard will be?

"The direct final rule requires compliance with the energy conservation standards applicable to non-weatherized furnaces starting on May 1,2013.   In an exercise of its enforcement discretion, DOE will, during the pendency of the litigation, act in a manner consistent with terms of the settlement agreement with regard to the enforcement of the standard"  or Its says to me will not enforce

Have they stopped the manufacture of furnaces below 90%?

No just no endorsement for the law that will be in place end of the April of this year.  All the HVAC sale people I have talked to are happy, I sat with a fella who has not ever installed a 90%  just 80% with base AC.  He needs training or retire.
